Terms of Use

1. Acceptance of Terms

By downloading or using FoodCheck (the "App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

These terms are governed by the laws of England and Wales.


2. About FoodCheck

FoodCheck is an iOS application that displays UK Food Hygiene Ratings sourced from the Food Standards Agency (FSA) public API. The App is provided by Dane Rich, an independent developer based in the United Kingdom.


3. Licence to Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to use FoodCheck on Apple devices that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

You may not:

  • Copy, modify, or distribute the App or its content
  • Reverse engineer or attempt to extract the source code
  • Use the App for any unlawful purpose
  • Attempt to circumvent any in-app purchase restrictions

4. Accuracy of Information

4.1 FSA Data

Food hygiene ratings displayed in the App are sourced from the Food Standards Agency (FSA) under the Open Government Licence v3.0. We display this data as provided and do not independently verify it.

Ratings reflect the most recent inspection on record and may not reflect current conditions. An establishment's hygiene standards may have improved or deteriorated since its last inspection.

You should not rely solely on this App when making decisions about food safety. Always use your own judgement and check the FSA website directly at https://ratings.food.gov.uk for the most current information.

4.2 Cached Data

When using the offline cache feature, data may be up to 48 hours old. A staleness indicator is shown where applicable.

4.3 Statistics Pages

The statistics pages at foodcheckuk.app present aggregated and derived figures based on FSA data. These figures are pre-computed from periodic snapshots and may not reflect the most current FSA dataset. Chain and area groupings are determined algorithmically and may not perfectly reflect a business's actual affiliation. Statistics are provided for general informational purposes only and should not be relied upon as authoritative or precise representations of FSA data.


5. In-App Purchases

5.1 FoodCheck Supporter

The App offers two in-app purchase options ("FoodCheck Supporter") that unlock additional features including favourites, notifications, alternate app icons, and offline city preloading:

  • Annual subscription auto-renews each year until cancelled. Your account will be charged for renewal within 24 hours prior to the end of the current billing period. To avoid being charged, cancel at least 24 hours before the end of the current period in your Apple ID subscription settings.
  • Lifetime purchase a one-time payment that grants permanent access.

5.2 Payment and Billing

All purchases are processed by Apple through the App Store. By making a purchase, you agree to Apple's payment terms. We do not process or store payment information.

5.3 Consumer Rights - Digital Content

Under the Consumer Rights Act 2015, digital content sold to consumers in the UK must be:

  • Of satisfactory quality
  • Fit for purpose
  • As described

If any purchased feature fails to meet these standards, you may be entitled to a repair, replacement, or refund. Please contact us at foodcheckuk@icloud.com in the first instance. You may also contact Apple for a refund via the App Store.

5.4 Cancellation and Refunds

Annual subscriptions can be cancelled at any time via your Apple ID subscription settings; access continues until the end of the current billing period. Lifetime purchases are non-refundable except where required by applicable law (including the Consumer Rights Act 2015) or Apple's refund policies.

To request a refund from Apple, visit https://reportaproblem.apple.com.

5.5 Restoring Purchases

You can restore previous purchases at any time using the "Restore Purchases" button in the App. This is tied to your Apple ID.


6. Intellectual Property

All content, design, and code within the App (excluding FSA data) is owned by Dane Rich and is protected by copyright. FSA data is used under the Open Government Licence v3.0.

The food hygiene rating badge designs are trademarks of the Food Standards Agency.


7. Feedback

If you provide suggestions, ideas, or other feedback about the App ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free licence to use and incorporate that Feedback into the App without any obligation or compensation to you.


8. Your Data

Most data (favourites, cache, and preferences) is stored locally on your device and never transmitted to us. When the app connects to our backend service (foodcheckuk.app), it sends an anonymous identifier alongside request metadata for rate-limiting and traffic monitoring purposes. We do not collect your name, email, precise location, favourites, or search terms.

9. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without any warranty of any kind. We do not warrant that:

  • The App will be uninterrupted or error-free
  • The data displayed will be accurate, complete, or current
  • The App will be compatible with all devices or iOS versions

Nothing in these terms affects your statutory rights as a consumer under UK law.


10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We shall not be liable for any indirect, incidental, special, or consequential loss or damages whatsoever, including without limitation damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use of or inability to use the App, however caused, regardless of the theory of liability (contract, tort, or otherwise), even if we have been advised of the possibility of such damages
  • Our total liability to you for all damages shall not exceed the amount you paid for the App (if any)

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law. Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so these limitations may not apply to you.


11. External Services

The App connects to the following services:

  • Food Standards Agency API to retrieve food hygiene rating data
  • Apple App Store / StoreKit to process in-app purchases
  • foodcheckuk.app backend (operated by us, hosted on Cloudflare Workers and D1) for inspection history, geocoded establishment data, and basic operational telemetry

We are not responsible for the availability, accuracy, or content of third-party services. Data displayed from external sources is for general informational purposes only and is not guaranteed by us.


12. Availability and Updates

We may update, modify, or discontinue the App at any time without notice. We are not obligated to provide updates, though we aim to maintain the App in good working order.


13. Termination

This licence is effective until terminated by you or us. Your rights under these Terms will terminate automatically if you fail to comply with any of their terms. You may also terminate your use at any time by deleting the App from your device.


14. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted at https://foodcheckuk.app/terms/ with a revised "Last updated" date. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.


15. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in Scotland or Northern Ireland, you may also have the right to bring proceedings in your local courts.

If you are a citizen of any European Union country, Switzerland, Norway, or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.

For disputes arising from App Store purchases, Apple's own dispute resolution processes may apply.
